Supreme Court Action Filed

Two members of the Lawyers’ Society, Thomas Moore Conteh, Esq. and Tamba Kellie, Esq., have filed an action in the Supreme Court of Sierra Leone challenging the purported passage of the Constitutional Amendment Bill 2025.
The application, filed on Thursday, 3 September 2026, seeks the Supreme Court’s interpretation of constitutional provisions relating to the voting threshold required to pass a constitutional amendment and the voting procedure that Parliament must follow.
The applicants have filed the matter in their individual capacities, citing the government’s refusal to allow the corporate registration of the Lawyers’ Society.
According to the Society, the action does not challenge Parliament’s legislative authority but seeks to ensure that any amendment to the Constitution complies with the requirements of the 1991 Constitution.
The Society said the applicants are asking the Supreme Court to determine whether Parliament followed the constitutional procedures in passing the Bill.
If the Court finds that the required procedures were not followed, the applicants are seeking a declaration that the purported passage of the Constitutional Amendment Bill 2025 is null and void.
The Lawyers’ Society said the protection of the rule of law and promotion of good governance remain central to its mandate and that it will keep the public informed about the progress and outcome of the case.
